Terms and Conditions

These Terms and Conditions govern the use of the AIMAILI website, and the purchase of services offered by Lasken GmbH. By creating an account, accessing the AIMAILI platform or submitting an order you agree to be bound by these Terms and Conditions.
1. Parties
1.1 Lasken GmbH is the contracting party for all services provided under the AIMAILI brand.

1.2 AIMAILI is a commercial brand owned and operated by Lasken GmbH for the marketing and sale of dataset services.
1.3 Paleo Sh p k is an independent external data provider that creates and delivers datasets purchased by customers through the AIMAILI interface. Paleo Sh p k is not a contracting party to these Terms and Conditions.

1.4 These Terms apply to global customers. All customers represent that they are acting for business purposes only and that they are not consumers under any applicable law.
2. Service Description
2.1 Lasken GmbH provides an online interface that allows customers to configure and submit requests for datasets.
2.2 Lasken GmbH does not create, access, store, view or process any dataset or any personal data contained in any dataset.
2.3 All datasets are created and delivered directly by Paleo Sh p k in its role as external provider. Paleo Sh p k is solely responsible for dataset generation, dataset structure, dataset content and compliance with data protection laws relating to dataset creation.
2.4 Lasken GmbH invoices customers, receives payments and provides customer support regarding accounts, billing and general inquiries.
2.5 Lasken GmbH may modify the AIMAILI interface, add or remove features, change pricing or suspend parts of the service for maintenance or security reasons at its discretion.
3. Ordering and Delivery
3.1 Customers submit dataset specifications through the AIMAILI interface.
3.2 After payment is confirmed, Lasken GmbH transmits abstracted order parameters to Paleo Sh p k. Order parameters do not include dataset content.
3.3 Paleo Sh p k creates and delivers the dataset directly to the customer using email or another secure method.
3.4 Delivery timelines are not guaranteed because dataset creation is the responsibility of the external provider.
3.5 Lasken GmbH does not store, archive or access any delivered dataset.
4. Customer Obligations
4.1 Customers must use datasets only for business to business outreach and business to business commercial purposes.
4.2 Customers are solely responsible for ensuring that their use, storage and processing of datasets complies with all applicable laws including data protection laws, privacy laws, ePrivacy rules, national marketing laws and any rules governing electronic communications.
4.3 Customers must implement appropriate security measures to protect the confidentiality and integrity of any dataset.
4.4 Customers must not attempt to obtain dataset content from Lasken GmbH and must not request Lasken GmbH to store or process any such content.
4.5 Customers must promptly delete datasets if required to do so by applicable law or regulatory authority.
5. Prohibited Uses
5.1 Datasets may be used only for lawful business to business purposes. Customers must not use any dataset
a. for consumer targeting or any outreach directed at private individuals
b. for political campaigning, political profiling or sensitive category activities
c. in any unlawful manner or in violation of applicable national or international laws
d. for automated scraping, automated enrichment or automated cross matching that is not permitted by applicable law
e. in combination with data sources that violate privacy, data protection or ePrivacy requirements
f. in a manner that infringes intellectual property or other third party rights
g. to build, support or train any competing dataset product or any competing data service
h. in violation of national or regional spam, marketing or communication regulations
i. in any context where the customer does not hold a lawful basis for outreach.
5.2 Lasken GmbH may suspend or terminate access to the AIMAILI service if it reasonably suspects that a dataset is being used in a prohibited manner.
6. Role of the External Provider
6.1 Paleo Sh p k is the independent external provider that creates and delivers datasets to customers.
6.2 Paleo Sh p k is solely responsible for sourcing publicly available data, creating datasets, determining dataset structure and ensuring that dataset processing complies with applicable data protection laws.
6.3 Lasken GmbH has no control over dataset content and does not access or review any dataset.
6.4 Lasken GmbH may forward customer inquiries relating to dataset content or data subject rights to Paleo Sh p k for handling.
7. Payment Terms
7.1 Payments are processed through Chargebee on behalf of Lasken GmbH.
7.2 Lasken GmbH does not store payment credentials.
7.3 Prices are displayed before order confirmation and depend on the parameters selected by the customer.
7.4 Completed and delivered orders are not refundable.
7.5 Lasken GmbH may offer a one time complimentary revision at its discretion if the customer demonstrates that the delivered dataset does not reasonably reflect the order specification. This goodwill offer does not constitute an ongoing obligation or warranty.
7.6 Taxes, payment provider fees and any currency conversion costs are borne by the customer.
8. Intellectual Property
8.1 All intellectual property rights in the AIMAILI brand, website, interface and service environment belong to Lasken GmbH.
8.2 All intellectual property rights in datasets belong to Paleo Sh p k.
8.3 Customers receive a limited, non exclusive, non transferable licence to use delivered datasets solely for internal business purposes and not for any onward sale or distribution.
9. No Warranty
9.1 The AIMAILI service is provided on an as is basis.
9.2 Lasken GmbH does not warrant the completeness, accuracy, quality, legality or suitability of any dataset.
9.3 Data obtained from public sources may be incomplete, outdated or subject to changes beyond Lasken GmbH control.
9.4 Lasken GmbH does not guarantee any commercial or operational outcome from the use of any dataset.
9.5 No implied warranties apply.
10. Liability
10.1 Nothing in these Terms excludes liability for fraud or for any liability that cannot be excluded under applicable law.
10.2 Lasken GmbH is not liable for
a. dataset content
b. dataset creation
c. dataset delivery
d. dataset accuracy, completeness or legality
e. any claim arising from data sourcing or dataset processing
f. any claim relating to compliance with data protection or privacy laws regarding dataset content
g. indirect or consequential losses including loss of profit or loss of business.
10.3 The total aggregate liability of Lasken GmbH arising from any order or from the customer use of the AIMAILI service shall not exceed the amount paid by the customer for the relevant order.
10.4 Paleo Sh p k bears sole responsibility for dataset creation and dataset compliance.
11. Customer Support and Communication
11.1 Lasken GmbH provides customer support for account issues, billing matters and general service inquiries.
11.2 Lasken GmbH may forward dataset related inquiries to Paleo Sh p k where appropriate.
11.3 Customers agree to receive service related communications electronically.
12. Data Protection and Privacy
12.1 Lasken GmbH acts as controller for account data, billing data, website usage data and communication records.
12.2 Lasken GmbH does not access or process any personal data contained in datasets.
12.3 Paleo Sh p k is the independent controller for any personal data contained within delivered datasets.
12.4 Rights requests relating to datasets will be transmitted to Paleo Sh p k.
12.5 Lasken GmbH may use cookies, analytics tools and technical logs for security, diagnostics and service improvement.
12.6 Further details are set out in the AIMAILI Privacy Policy issued by Lasken GmbH.
13. Changes to the Service and Contract
13.1 Lasken GmbH may update the AIMAILI service including features, pricing and technical functionality.
13.2 Lasken GmbH may amend these Terms. Updates will be published on the AIMAILI website. Continued use of the service constitutes acceptance of updated Terms.
14. Termination
14.1 Lasken GmbH may suspend or terminate access if
a. the customer breaches these Terms
b. the customer engages in prohibited use
c. payment is not received
d. service security requires temporary or permanent suspension.
14.2 Customers may discontinue use at any time. Payments already made are not refundable.
15. Miscellaneous
15.1 These Terms constitute the entire agreement between the customer and Lasken GmbH.
15.2 If any provision is invalid, the remainder shall remain in effect and the invalid provision shall be replaced with a valid provision that best reflects the original intent.
15.3 Customers may not assign or transfer their rights without the prior written consent of Lasken GmbH.
15.4 Lasken GmbH may assign these Terms to an affiliated entity.
16. Governing Law and Jurisdiction
These Terms are governed by German law. The courts of Munich, Germany shall have exclusive jurisdiction for all disputes arising from or relating to these Terms or the AIMAILI service.
